ShopMyNest LLC (“ShopMyNest,” “we,” “us,” or “our”) respects intellectual property rights and expects everyone who uses the ShopMyNest website at shopmynest.com and the ShopMyNest mobile app (together, the “Service”) to do the same. This Intellectual Property & DMCA Policy explains how to report copyright, trademark, or right-of-publicity infringement on the Service, how a reported Seller can respond, and how ShopMyNest handles its own brand and marks.

This policy is separate from the mediation process for orders that arrive damaged, not as described, or that never arrive — those are handled under the Return & Refund Policy.

1. ShopMyNest’s role

ShopMyNest is a marketplace venue. Sellers list, describe, price, photograph, and ship their own items. ShopMyNest is not the seller of items listed on the Service and does not take title to items at any point (see Terms of Service). Because ShopMyNest is a venue, we rely on rights holders to tell us when listings, photos, or other content on the Service infringe their rights, and we operate a notice-and-takedown process consistent with 17 U.S.C. §512 (the “DMCA safe harbor”).

2. Copyright — how to report infringement

If you believe material on the Service infringes a copyright you own or are authorized to enforce, send a written notice to help@shopmynest.com with the subject line “DMCA Notice.” Your notice must include all of the following, which mirrors 17 U.S.C. §512(c)(3):

  1. Identification of the copyrighted work you claim has been infringed (or, for multiple works on the Service, a representative list).
  2. Identification of the material you claim is infringing, in enough detail for us to find and remove it — please include the full URL of the listing or other page on the Service, and, where applicable, the shop name.
  3. Your contact information: full legal name, mailing address, telephone number, and email address.
  4. A statement made in good faith that you believe the use of the material as complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
  6. Your physical or electronic signature (typing your full legal name below the statement is sufficient for an electronic signature).

Notices missing any of these elements may not be actionable and may be returned for correction.

3. What happens after a valid notice

When we receive a notice that meets Section 2, we will:

  1. Remove or disable access to the reported material.
  2. Notify the affected Seller and forward a copy of the notice (redacting your contact information if you ask us to, to the extent permitted by law).
  3. Log the notice against the Seller’s account for the purposes of the repeat-infringer policy in Section 6.

4. Counter-notice

If you are a Seller whose material was removed and you believe the removal was a mistake or a misidentification, you may file a counter-notice by emailing help@shopmynest.com with the subject line “DMCA Counter-Notice.” Your counter-notice must include:

  1. Identification of the material that was removed and the location where it appeared on the Service before removal (URL or listing ID).
  2. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  3. Your name, mailing address, and telephone number.
  4. A statement that you consent to the jurisdiction of the United States District Court for the District of New Hampshire, or, if you reside outside the United States, of any judicial district in which ShopMyNest may be found, and that you will accept service of process from the person who filed the original notice or their agent.
  5. Your physical or electronic signature.

If we receive a valid counter-notice, we will forward it to the person who submitted the original notice. Unless that person files a court action seeking to restrain the alleged infringement within ten (10) to fourteen (14) business days, we may restore the removed material.

5. Trademark and right-of-publicity reports

We also accept reports of trademark infringement and right-of-publicity or right-of-privacy violations. Send them to help@shopmynest.com with the subject line “Trademark Notice” or “Right of Publicity Notice.” Include:

  • Your name, mailing address, telephone number, and email address.
  • For trademark reports: the registered mark (with registration number and jurisdiction if applicable), the goods or services it covers, and the URL of the listing or other content you are reporting.
  • For right-of-publicity or right-of-privacy reports: the name of the person depicted, a description of the content, and the URL of the listing or other content you are reporting.
  • A good-faith statement that the use complained of is not authorized, and a statement, under penalty of perjury, that the information is accurate and that you are authorized to act.
  • Your physical or electronic signature.

We follow a similar takedown, notification, and counter-notice process for trademark and right-of-publicity reports.

6. Repeat-infringer policy

ShopMyNest will terminate, in appropriate circumstances, the accounts of Sellers or users who are the subject of repeated valid infringement notices. A Seller who accumulates multiple valid notices (typically three within twelve months, sooner in egregious cases) is subject to termination under Terms of Service §12 and the Seller Agreement.

7. Abusive notices

Under 17 U.S.C. §512(f), any person who knowingly and materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys’ fees. ShopMyNest may reject, deprioritize, or refuse to act on notices from senders who have a pattern of filing bad-faith or automated notices without meaningful review.

8. ShopMyNest’s own intellectual property

The ShopMyNest name, the nest-and-bird mark, the “ShopMyNest” wordmark, our logos, the design and look-and-feel of the Service, and the software that powers the Service are the property of ShopMyNest LLC or our licensors. Nothing in these policies gives you a license to use them except as described below.

8.1 “Sold on ShopMyNest” badge

Sellers in good standing may use a “Sold on ShopMyNest” badge on their own website, social media, and packaging inserts to indicate that they sell on the Service. Follow any brand guidelines we publish; use the badge only in the artwork we provide; do not modify the colors or proportions; and do not use it in a way that implies endorsement, partnership, employment, or exclusive distribution beyond the fact that you sell on ShopMyNest. We may ask you to stop using the badge if we terminate your Seller account or if you use it in a way that misleads Buyers.

8.2 Press and editorial use

Journalists and researchers may use the ShopMyNest name and logo to refer to ShopMyNest in news, reviews, and academic work. For a full media kit, email help@shopmynest.com.

8.3 Feedback

If you send us suggestions, feature ideas, or feedback about the Service, you agree we may use them without restriction and without owing you anything.

9. Relationship to other policies

This policy handles rights-based takedowns. Issues with items that arrive damaged, that don’t match the listing, or that never arrive are handled under the Return & Refund Policy. Conduct issues (harassment, hate speech, off-platform steering, review manipulation) are handled under the Community Guidelines, the Anti-Discrimination Policy, and the Seller Agreement. Prohibited-item categories are listed in the Prohibited & Restricted Items Policy.

10. Changes to this policy

We may update this policy as the Service and applicable law evolve. Material changes will be announced through the Service or by email.
