Revision date: October 23, 2026. Published revisions apply subject to applicable notice requirements and the terms saved with existing purchases.
ShopMyNest is a marketplace for handmade and one-of-a-kind goods, open to independent makers and to buyers across the United States. This Anti-Discrimination Policy explains what ShopMyNest LLC ("ShopMyNest," "we," "us," or "our") expects from everyone who uses the ShopMyNest website at shopmynest.com and the ShopMyNest mobile app (together, the "Service"), and what we do when someone discriminates against, or harasses, another user or a member of our team.
This policy sits alongside the Community Guidelines, the Terms of Service, and the Seller Agreement.
1. Our commitment
ShopMyNest is committed to a marketplace where makers and buyers are welcome regardless of race, color, ethnicity, national origin, ancestry, religion, sex, gender, gender identity, gender expression, sexual orientation, marital or family status, pregnancy, disability, medical condition, genetic information, age, veteran or military status, citizenship or immigration status, or any other characteristic protected by federal, state, or local law in the United States.
We use "protected characteristic" in this policy to refer to any of the categories above.
2. What Sellers may not do
If you sell on the Service, you may not:
- Refuse to sell to a Buyer, cancel a Buyer's order, or refuse to ship to a Buyer's address on the basis of a protected characteristic.
- Charge different prices, offer different shipping options, or apply different return terms to Buyers based on a protected characteristic.
- Write listings, shop names, shop bios, seller updates, or Blog submissions that demean, threaten, or discriminate against a protected group.
- Use photos, packaging, or included inserts that carry hateful or discriminatory imagery or messages.
- Send discriminatory or harassing in-app messages to Buyers, other Sellers, or ShopMyNest staff.
Legitimate business decisions that are not based on a protected characteristic — for example, refusing an order because the item is out of stock, because a shipping address is outside the US, or because the Buyer has a documented pattern of chargeback fraud — are not discrimination under this policy.
3. What Buyers may not do
If you buy on the Service, you may not:
- Send harassing, threatening, or discriminatory messages to a Seller, another Buyer, or ShopMyNest staff on the basis of a protected characteristic.
- Leave reviews that target a Seller's protected characteristic instead of the order (see the Community Guidelines — Review-specific rules).
- Use the Service to organize harassment or a coordinated review-bombing campaign against a Seller based on a protected characteristic.
4. Where this policy applies
This policy applies to every part of the Service, including:
- Listings, photos, listing titles, and listing descriptions.
- Shop names, shop bios, seller updates, and Blog posts.
- In-app messages between Buyers and Sellers.
- Reviews and public replies to reviews.
- Communications with ShopMyNest customer support, mediators, and other staff — by email, chat, or phone.
It also applies to conduct that happens off-platform when that conduct targets another ShopMyNest user or ShopMyNest staff because of a protected characteristic, and we can reasonably tie the account to the conduct.
5. Hate items
Items that promote hate, violence, or discrimination against a protected class are separately prohibited under the Prohibited & Restricted Items Policy and Seller Agreement §3.3. Listing a hate item is a violation of both this policy and the item rules, and typically leads to immediate removal.
6. Identity- and heritage-affirming content is welcome
Celebrating and representing your own community, faith, heritage, or identity in your shop, your listings, or your Blog posts is not discrimination under this policy — it is part of what makes an independent-maker marketplace worth having. A shop that focuses on Pride merchandise, on a specific religious tradition's craft, on a particular heritage's textile art, or on disability-community themes is welcome on ShopMyNest so long as the content doesn't demean, threaten, or discriminate against anyone else.
7. Reporting a violation
If you see or experience discrimination, harassment, or hateful content on the Service:
- Use the in-app "Report" button on the listing, message, review, or Blog post.
- Or email
help@shopmynest.comwith a link to what you're reporting and a short description. If you were targeted directly, please share as much detail as you're comfortable with — screenshots and message IDs help us act quickly.
You may report anonymously. ShopMyNest will not disclose your identity to the reported party except where required by law or by a valid legal process. Retaliation against a person who reports a violation is itself a violation of this policy.
8. Enforcement
ShopMyNest reviews reports promptly. For confirmed discrimination or harassment on the basis of a protected characteristic, we typically:
- Immediately remove the offending listing, message, review, or Blog post.
- Suspend the account pending review.
- Terminate the account under Terms of Service §12 or Seller Agreement §12 for serious or repeated violations.
For a Seller account, termination triggers the wind-down procedure in Seller Agreement §12.3, including shipment or cancellation of open orders. For a Buyer account, termination means the account is closed and any pending disputes are resolved under the Return & Refund Policy.
Where content or conduct may be unlawful, we may also report it to appropriate authorities.
9. Appeals
If you believe an enforcement action under this policy was in error, reply to the enforcement email or write to help@shopmynest.com within 14 days. ShopMyNest will review the appeal and the relevant evidence; the original decision may be changed. Our decision on appeal is final for the purposes of the Service.
10. Changes to this policy
We may update this policy as the Service and applicable law evolve. Material changes will be announced through the Service or by email.
